About These Terms

These terms of use (Terms) govern your access to and use of yac.org.au (the Site), operated by Yurruungga Aboriginal Corporation (ABN 18 542 672 198) (YAC, we, us, our). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Use of the Site

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit their use of the Site. You must not:

  • interfere with or disrupt the Site or its servers;
  • attempt to gain unauthorised access to any part of the Site;
  • use the Site to transmit unlawful, harmful, or misleading content;
  • use automated means (including scraping, crawling, or harvesting) to extract content from the Site without our prior written permission.

Intellectual Property

All content on the Site — including text, graphics, logos, images, audio, video, and code — is owned by YAC or its licensors and is protected by Australian and international copyright and trade mark laws. Except as expressly permitted, you may not reproduce, distribute, modify, publish, or create derivative works from any content without our prior written permission.

Indigenous Cultural and Intellectual Property

YAC recognises and respects Indigenous Cultural and Intellectual Property (ICIP) rights. Cultural knowledge, stories, language, designs, imagery, songs, and practices shared on this Site remain the cultural property of the Gumbaynggirr people and their relevant custodians. Nothing on this Site grants you any right to use, reproduce, adapt, or commercialise ICIP without the free, prior, and informed consent of the relevant custodians. If you wish to use any ICIP shared on the Site, please contact us first.

Information You Submit

When you submit information to us through forms, enquiries, event submissions, or similar channels, you:

  • confirm the information you provide is accurate and current;
  • grant us permission to use, store, and process that information for the purposes described in our Privacy Policy;
  • warrant that your submission does not infringe any third party's rights.

We may decline, edit, or remove any submission at our discretion.

Donations

Donations made through the Site are processed by our third-party payment provider (Stripe). Donations are, by default, non-refundable except as required by law. If you believe a donation has been made in error, please contact us promptly and we will do our best to assist.

Tax-deductibility of donations depends on YAC's current deductible gift recipient (DGR) status and your personal circumstances — please retain your receipt and consult your tax adviser.

Information About Services

Information on the Site about our cultural services, programs, events, and providers is provided in good faith for general information purposes only. While we take care to keep it accurate and current, we make no warranties about its completeness, accuracy, or suitability for any particular purpose. You should contact us directly to confirm current details before relying on any information for decision-making.

Third-Party Links

The Site may contain links to third-party websites. We provide these for convenience only and do not endorse or accept responsibility for the content, privacy practices, or availability of any third-party site. Your use of a linked site is at your own risk and subject to that site's terms.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

Disclaimer and Limitation of Liability

To the maximum extent permitted by law, and subject to the Australian Consumer Law section above:

  • we do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components;

Where our liability cannot be excluded but may be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having the service re-supplied.

Indemnity

You agree to indemnify and hold harmless YAC, its directors, officers, employees, and agents from any claim, loss, damage, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Site, or your infringement of the rights of any third party.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You and we each submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia in respect of any dispute arising out of or in connection with these Terms or the Site.
